Terms of Service

1. The provider

2. Scope and formation of the contract

These terms cover the hosting, virtual server, domain, DNS and mailbox services the provider offers.

The contract is formed electronically, by placing an order in the customer portal. Before ordering, the customer reads and accepts these terms and the privacy notice. The contract is not reduced to a signed document; the provider records it electronically.

The steps of electronic contracting, the means of correcting input errors and the language of the contract (Hungarian) are shown in the portal, in line with the Hungarian E-Commerce Act (2001. évi CVIII. törvény, "Ekertv.") §§ 5-6.

3. Fees and payment

The provider is exempt from VAT under the small-business exemption (alanyi adómentesség, AAM) in Chapter XIII of the Hungarian VAT Act (2007. évi CXXVII. törvény). Prices do not include VAT and invoices carry none.

After an order is placed the provider issues a proforma invoice. The service activates once payment arrives. The provider then issues an invoice through KBOSS.hu Kft. (Számlázz.hu).

We notify you of the invoice by e-mail; the document itself is downloaded from the customer portal as a PDF.

Payment is currently by bank transfer. The customer may top up a service balance in the portal, from which renewals are taken automatically.

4. Right of withdrawal

A customer who is a consumer has a 14-day right of withdrawal without giving reasons, under Government Decree 45/2014. (II. 26.).

That right is lost where the provider begins performance within the 14 days at the customer's express prior request, and the customer has acknowledged that they lose the right of withdrawal once performance begins.

Because the service activates immediately on payment, the customer must make both of those declarations during ordering.

5. Availability and support

The provider aims for 99.9% monthly availability. This is a target; planned maintenance, force majeure and outages caused within the customer's own sphere do not count towards it.

Where availability persistently falls short in a calendar month, the customer may request in writing a proportionate credit of the monthly fee to their service balance. The credit is not automatic.

Our support aims to give a first response within 8 working hours. That is a target, not a contractual commitment.

6. Backups — please read this

The customer is responsible for backing up data held in their hosting or virtual server. The provider's own backups exist for disaster recovery; they are not a customer restore service, and the provider does not currently offer individual data restoration.

We would rather say this than promise something we cannot deliver.

7. The customer's obligations

The customer is responsible for the accuracy of the data they provide, for keeping their credentials secure, and for everything done through their access.

The customer must ensure that the content they store complies with the law and does not infringe the rights of others.

8. Prohibited content and use

The following are prohibited in particular: publishing unlawful or infringing content; sending unsolicited bulk e-mail; unauthorised probing or attacking of other systems; and resource use that degrades other customers' service on shared infrastructure.

The provider may suspend the service for breach of this section.

9. Liability for stored content

As a hosting provider the provider acts under Ekertv. §§ 7-13. On becoming aware that stored content is unlawful, the provider applies the notice-and- takedown procedure set out in that act.

The provider does not monitor the content stored and does not seek out indications of infringement.

10. Limitation of liability

The provider's liability is limited to the fee paid for the service. The provider is not liable for lost profit, for indirect loss arising from data loss, or for the loss of data stored by the customer — section 6 governs the latter.

This limitation does not affect the rights a consumer has by law.

11. Renewal and termination

Services renew on the billing cycle chosen. The customer may cancel renewal at any time in the portal; the service then runs to the end of the period already paid for.

After a service ends, its data is retained for 30 days and is then permanently deleted. That deletion is irreversible.

Deleting a database follows the same principle: the database becomes unreachable immediately, the data is kept for 30 days and can be restored from the portal at any point in between, and after that it is destroyed for good.

12. Processing the customer's data

For data the customer places into the service (website, database, mailbox, DNS zone) the customer is the controller and the provider is the processor. The provider processes it only on the customer's instructions, only as far as providing the service requires, and under a duty of confidentiality.

The provider may access the customer's database for troubleshooting or to investigate abuse; every such access is logged.

The web server writes an access log containing visitors' IP addresses, which the provider processes for operations and security.

The further processors the provider uses are listed in the privacy notice.

13. Complaints and disputes

Send complaints to info@carbonhost.hu; we answer within 30 days.

In a consumer dispute the customer may turn to a conciliation board. The board competent for the provider's seat: Baranya Vármegyei Békéltető Testület, 7625 Pécs, Majorossy Imre u. 36. Consumer-protection complaints may be made to the competent government office.

14. Amendments

The provider may amend these terms. We will notify the customer by e-mail to their registered address at least 15 days before a change takes effect. A customer who does not accept the change may terminate the service before then.

15. Governing law

Matters not covered here are governed by the Hungarian Civil Code (2013. évi V. törvény), the Ekertv. and the legislation applicable to consumer contracts.
